桃園縣吉佳生技公司負責人劉宏清父子，佯稱自行調配混充的奶粉是自紐西蘭原裝進口，銷售兩岸；甚至塗銷過期奶粉的製造及保存日期後重新噴印延長期限。新北地院昨天依詐欺等罪判劉三年六月徒刑；劉的兩名兒子通緝中。

法官批評劉宏清（六十七歲）父子為一已之私，欺騙消費者，賣混充及過期奶粉，罔顧企業良知，惡性重大。

判決指出，劉宏清是桃園縣吉佳生技、以勒行及新北市五股區豐堤納等三家公司負責人，他兒子劉先智、劉昀智負責協助處理公司奶粉製造及銷售業務。

劉與兩名兒子考量原裝進口的奶粉成本較高，二○○九一月到二○一○年十月，自紐西蘭進口奶粉原物料後，再以自行調製的配方，加工混充麥芽糖精、葡萄糖等添加物。

劉宏清父子為促銷奶粉，透過業務員向藥局佯稱自行調配的奶粉是紐西蘭原裝進口的「卡洛吉蒂」奶粉，是知名「卡洛塔妮」羊奶粉的副廠牌，來自相同乳源，在台灣及大陸銷售，讓消費者誤信是紐西蘭原裝進口的奶粉而購買。

劉宏清父子見存貨未銷完，將過期或已過期奶粉罐底的製造日期及保存期限塗銷重新噴印，延長期限三年，再把這些過期奶粉賣到大陸浙江、四川等地。

檢調前年三月接獲檢舉，搜索劉宏清的公司查扣兩千多罐奶粉；檢驗並未發現有危害人體成分。

劉宏清的兩名兒子潛逃未到案；劉宏清辯稱，該公司「卡洛吉蒂」奶粉和添加物都是原裝進口，他未要求業務員向藥局佯稱是知名奶粉「卡洛塔妮」的副牌，更未賣過期奶粉。該公司銷售到大陸的奶粉未標示「紐西蘭原裝進口」，標示「原裝進口」代表自台灣「原裝進口」到大陸，並沒有錯。

【郭美瑜／台北報導】北市教育局統計，北市公立中小學有94校營養午餐使用富味鄉問題油品，擬向業者求償。台北市長郝龍斌今表示，求償金額還未出爐，但近期食安案件已涉及民生詐欺，市府消保官將協助保障民眾權益。

郝龍斌表示，大統及富味鄉製造問題油品，應定位為民生詐欺業者，虛偽造假，以低廉食材製造，以高價售出。

郝說，棉酚非油溶性，高溫壓榨時也會破壞棉酚、起化學反應，高溫加熱時也會揮發，要在油品內檢驗到棉酚非常困難。他也說，棉酚含量低並非沒有，況且儀器也有檢驗極限，未檢出是正常的，但不代表油品沒問題、消費者食用後不會產生危害，最重要的還是民生詐欺的問題。

近期接連出現食品安全案件，國民黨榮譽主席連戰女兒連惠心代言的健康食品也遭踢爆含西藥，郝龍斌表示，這些案件可讓代言人及消費者了解，代言人對代言商品要負起責任，應確認食品安全無虞才代言。
