食管法修正案　提高罰款額度且納食安基金

【蔡明樺／台北報導】食品安全連環爆，大統長基公司混油不法利得挨罰18.5億元，總統馬英九昨出席國民黨19全大會中宣示，未來對黑心食品業者的不法利得裁罰「沒有上限」，衛福部長邱文達今指，《食品衛生管理法》修正草案已送到政院，食品標示不實的最高罰鍰從20萬提高到400萬，食品摻偽假冒刑責從3年以下提高到5年以下，待政院審查後很快就會送進立院，針對不法利得無上限，邱強調：「此舉有嚇阻作用，樂觀其成。」

食品藥物管理署組長蔡淑貞說，草案已將「食品安全保護基金」入法，避免消費者受害求償無門，針對不法利得無上限部分，摻偽假冒部分若超出現行《食管法》最高1500萬元罰款時，是否賺多少、賠多少，該署將與法務部、財政部再研議。
