有關特別休假天數，依勞基法規定1至不滿3年者為每年7天，員工於101.09.10到職，所以102.09.10可以有7天特休但公司可要求第一年度(102.09.10~102.12.31)可請之特休為2天，剩下5天要求(103.01.01~103.09.09)前休完. 而於第2年屆滿時（1030909）又有7天之休假,也是分成(103.09.10~103.12.31)有兩天 (104.01.01~014.09.09)有五天.(加起來也是七天) 所以你每年的年假其實都要分到職日前及到職日後. 所以你103.05.01離職確實只有五天, 如你在103.09.10離職就會有7天 P.S.大部份的公司都不會這麼小氣啦,不過小氣並不違法 ※ 引述《Pixarpinter (Pixar)》之銘言： : 不好意思　關於特休問題想請教一下 : 我是在101.9.10到職 : 將於103.5.31離職 : 依我的認知今年應該有完整的7天特休可以利用 : 不過HR方才告知　我只有5天可請 : 因為依任職時間來看　要從102.9.10　到　103.9.10才有7天特休， : 102年公司依比例給了我2天特休 : 我若於五月份離職的話　應扣除去年已休的2天... : 還請各位幫忙看一下，HR這樣的說法是正確的嗎？ : 謝謝~~~ -- ※ 發信站: 批踢踢實業坊(ptt.cc), 來自: 125.227.198.181 ※ 文章網址: http://www.ptt.cc/bbs/Salary/M.1400814697.A.6EF.html
