立法院今（6）日三讀通過軍事審判法修正草案，國民黨立院黨團書記長賴士葆表示，這是「一次到位、兩階段實施」，包含凌虐罪、不應懲罰而懲罰罪、阻撓部屬陳情罪等案，將自軍審法修法公告後，立即從軍法機關移轉到一般司法機構偵辦，至於其他案件將在公告後5個月後施行，陸軍下士洪仲丘案也將在該法公告後立即移由民間司法機關偵辦。
依據立法院修正三讀的軍審法條文，現役軍人非戰時犯陸海空軍刑法第四十四條至第四十六條，及第七十六條第一項、前款以外陸海空軍刑法或其特別法之罪時，將依刑事訴訟法追訴、處罰。
修正條文中也訂定，自修正公告後，偵查、審判程序尚未終結者，偵查中案件移送該管檢察官偵查，審判中案件移送該管法院審判，但本法修正施行前以依法定程序進行之訴訟程序，其效力不受影響。
裁判確定之案件，不得向該管法院上訴或抗告。但有再審或非常上訴事由者，得依刑事訴訟法聲請再審或非常上訴。
至於刑事裁判尚未執行或在執行中者，將移送該管檢察官指揮執行。
國民黨立院黨團副書記長廖正井說，本次修法把凌虐、、殺人、傷害、竊盜等都要移送到司法機構，現在偵查中跟審理中的案件、判刑確定，但還在審或是非常上訴、應執行還未執行的都將全部移往司法機構，同時司法院也要設軍事專業法庭，並培訓專業法官。
賴士葆說，司法院已經表示會積極面對軍審法修法帶來的影響，並培訓相關法官，至於現行軍檢跟軍審的人未來要如何轉型，「軍法司司長說會有一套作法，如果軍法官要轉為法官，應該要經過考試等方式，這會跟國防部研究」。
