佯稱與兄同歸於盡 男判2年半

（中央社記者黃意涵台北17日電）陳姓男子與胞兄因細故起口角，將汽油淋在頭部後抱住胞兄佯稱要「同歸於盡」。最高法院今天依殺人未遂罪判刑2年6月。

根據判決書指出，台北市42歲陳姓男子去年6月間，因分擔網路費用問題與胞兄起口角，憤而將機車放倒後，用寶特瓶接油箱內的汽油，淋在自己頭上。

陳男隨後衝進屋內抱住胞兄，手持打火機，揚言「要跟你同歸於盡」，所幸陳男手中的打火機被胞兄打落，才未釀成悲劇。

台北地方法院依預備殺人罪，判處陳男有期徒刑6月，得易科罰金，緩刑3年，緩刑期間付保護管束，並應提供80小時義務勞務。

台灣高等法院審理認為，陳男當時應有點火意圖，且若真的點燃，將導致屋毀人亡，改依殺人未遂罪論罪。

高院審酌被害人於法院審理時，表示同意原諒陳男，給予自新機會，且仍與陳男同住，相處並無問題等，判處2年6月徒刑。

全案經最高法院駁回上訴定讞。1020717
