車禍現場沒監視器

我上個月在某個大路口發生車禍
我綠燈行過斑馬線時他變黃燈
當時時速大約40~50
我如果停下來的話就停在馬路中間了
於是我就過了
突然機車從我的右方衝出
我看到他的時候他已經在我的右邊了(3頓半貨車)
於是我就往左邊閃他
他就往我的右方後輪撞上
現場也沒監視器我該怎麼看他有沒有闖紅燈
那到底是誰的錯
